8.General Conditions:<\/strong> To the extent allowed under applicable law, Sponsor is not\u00a0<\/span>responsible for lost, late, misdirected, undelivered, incorrect, or inaccurate entry\u00a0<\/span>information whether caused by Internet users or by any of the equipment or\u00a0<\/span>programming associated with or utilized in the Sweepstakes or by any technical or\u00a0<\/span>human error which may occur in the processing of the entries. \u00a0Sponsor reserves the\u00a0<\/span>right to cancel, suspend and\/or modify the Sweepstakes, or any part of it, if any\u00a0<\/span>fraud, bugs, virus, technical failures, or any other factor beyond Sponsor\u2019s\u00a0<\/span>reasonable control impairs the integrity or proper functioning of the Sweepstakes,\u00a0<\/span>as determined by Sponsor in its reasonable discretion. Sponsor reserves the right, in its reasonably exercised\u00a0<\/span>discretion, to disqualify any individual and his\/her entries it finds to be tampering\u00a0<\/span>with the entry process, the website, or the operation of the Sweepstakes or to be\u00a0<\/span>acting in violation of the Official Rules of this or any other promotion or in an\u00a0<\/span>unsportsmanlike or disruptive manner. 9. Binding Arbitration:<\/strong> Any controversy or claim arising out of or relating to this\u00a0<\/span>Sweepstakes shall be subject to the jurisdiction determined by applicable law or\u00a0<\/span>otherwise settled by binding arbitration in a location determined by the arbitrator\u00a0<\/span>as set forth herein (provided that such location is reasonably convenient for\u00a0<\/span>claimant), or at such other location as may be mutually agreed upon by the parties,\u00a0<\/span>in accordance with the procedural rules for commercial disputes set forth in the\u00a0<\/span>Comprehensive Arbitration Rules and Procedures of JAMS (\u201cJAMS Rules and\u00a0<\/span>Procedures\u201d) then prevailing, and judgment upon the award rendered by the\u00a0<\/span>arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator\u00a0<\/span>shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall\u00a0<\/span>apply Michigan law consistent with the Federal Arbitration Act and applicable\u00a0<\/span>statutes of limitations and shall honor claims of privilege recognized at law. In the\u00a0<\/span>event that the claimant is able to demonstrate that the costs of arbitration will be\u00a0<\/span>prohibitive as compared to the costs of litigation, Sponsor will pay as much of the\u00a0<\/span>claimant\u2019s filing and hearing fees in connection with the arbitration as the arbitrator\u00a0<\/span>deem necessary to prevent the arbitration from being cost-prohibitive. If any part of\u00a0<\/span>this arbitration provision is deemed to be invalid, unenforceable or illegal (other\u00a0<\/span>than that claims will not be arbitrated on a class or representative basis), or\u00a0<\/span>otherwise conflicts with the rules and procedures established by JAMS, then the\u00a0<\/span>balance of this arbitration provision shall remain in effect and shall be construed in\u00a0<\/span>accordance with its terms as if the invalid, unenforceable, illegal or conflicting\u00a0<\/span>provision were not contained herein. If, however, the portion that is deemed invalid,\u00a0<\/span>unenforceable or illegal is that claims will not be arbitrated on a class or\u00a0<\/span>representative basis, then the entirety of this arbitration provision shall be null and\u00a0<\/span>void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute.\u00a0<\/span>Upon filing a demand for arbitration, all parties to such arbitration shall have the\u00a0<\/span>right of discovery, which discovery shall be completed within sixty days after the\u00a0<\/span>demand for arbitration is made unless further extended by mutual agreement of the\u00a0<\/span>parties. \u00a0<\/span><\/p>\n <\/p>\n
THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL\u00a0<\/span>BE IN THE ENTRANT\u2019S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS\u00a0<\/span>MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE\u00a0<\/span>ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS\u00a0<\/span>OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS\u00a0<\/span>SWEEPSTAKES IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY\u00a0<\/span>ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.<\/span><\/p>\n <\/p>\n
