StockX Card Breaking Policy
This Policy
This policy provides rules for card Breaks on StockX’s Live Shopping Platform and what
happens if the rules are not followed.
What is a “Break”?
A “Break” is a sale format in which a Live Seller offers a sealed pack, box or case of trading cards (“Card Set”) and opens it on a live stream to reveal the cards contained in the Card Set. In a Break, the cards from the Card Set may be split among multiple Live Buyers based on defined criteria (e.g., team, player, or serial-number digit) (“Slots”), or the entire Card Set may be sold to a single Live Buyer. The Visibility Requirements (as defined below) apply to every Break. The Slot-based Disclosure Requirements (as defined below) apply only to Slot-based Breaks, not to a Break where the entire Card Set is sold to a single Live Buyer.
Applicability of the Policy
This policy applies to anyone who runs, hosts, or takes part in a Break on the Live Shopping Platform, no matter what tools or methods they use to run it.
Participation in Breaks, whether as a Live Seller or a Live Buyer, is limited to individuals in the United States, who are at least eighteen (18) years of age or the age of majority in their jurisdiction, whichever is greater.
Compliance with Law
Live Sellers and Live Buyers are each responsible for following all applicable laws and regulations. Among other things, Live Sellers must comply with all applicable consumer protection and unfair and deceptive advertising laws, regulations and applicable regulatory guidance, including those relating to the Federal Trade Commission rules on endorsements, testimonials, and advertising, and all federal and state consumer-protection and unfair and deceptive advertising laws.
Permissible Offerings
Currently, Live Sellers may only offer for sale: (i) individual, specifically identified cards; (ii) a complete Card Set as originally packaged and sealed by the original card manufacturer (“Original Sets”); or (iii) a Repack that complies with the Repacks section of this policy below. Except as permitted under the Repacks section, repackaged sets are prohibited. A repackaged set is any set other than an Original Set, including where Original Sets are opened and cards are rearranged to form a new Card Set.
Where a Break involves the sale of the entire Card Set to a single Live Buyer, the Card Set as a whole may only be sold to that one Live Buyer; no fractional interests may be sold. For Slot-based Breaks, where a Live Buyer purchases a specific Slot, each Slot may only be assigned to one Live Buyer, and no fractional interests in a Slot may be sold. If no card matching the Live Buyer’s Slot is revealed in the Break, the Live Seller must provide the Live Buyer with an alternative card, Card Set or a full refund. The Live Seller must disclose how the alternative card or Card Set will be determined or if a refund will be provided at the time the Break is listed (together with the disclosure obligations in this paragraph, the “Slot-based Disclosure Requirements”).
Card Breaking Technology
StockX does not currently offer its own card-Breaking tools. Live Sellers running Breaks today must use their own methods in accordance with applicable law and this policy.
Breaks must be fully visible and genuine
Everything about a Break must be fully transparent and happen live on camera, from the moment a Card Set is offered for sale, a Card Set is broken and every card of the Card Set is revealed (“Card Break Session”) (together, the “Visibility Requirements”). This includes the sealed Card Set itself, any tools being used, and the Live Seller’s hands throughout the Card Break Session. Nothing may be offered, opened, sorted, or handled off-camera before it is revealed to Live Buyers. All camera footage must be genuine, unaltered footage of the live event, in real-time, for the duration of the Card Break Session.
Clear Disclosures
Before a Break is offered, the Live Seller must clearly disclose all relevant information about the offer for a given Card Set, both verbally on the livestream and in writing in the listing or stream description. At a minimum, the Live Seller must disclose:
- a clear and complete description of the Card Set, the number of packs or boxes in the Card Set and, its purchase price;
- the manufacturer and all manufacturer disclosures that accompanied the purchase of the Original Set;
- a representation that the Card Set is an authentic Card Set as originally packaged and sealed by the card manufacturer; and
- for any Slot-based Break, the specific Slot assignment method (e.g., buyer selection or auction), the alternative card, Card Set or refund the Live Buyer will receive if no card matching the Slot is revealed in the Break, the criteria for distributing any base or bulk cards, and the rule for distributing any card that matches more than one Slot (e.g., a card featuring multiple teams or players).
Open Til You Hit Format
In a “Open Til You Hit” format, a Live Buyer pays a flat fee and the Live Seller opens packs sequentially until a qualifying card (a “Hit”) is revealed or the Safety Cap is reached. Before offering an Open Til You Hit Break, the Live Seller must clearly disclose: (i) the definition of a qualifying Hit (e.g., autograph, relic, or serial-numbered card at or below a specified threshold); (ii) the flat fee to be paid by the Live Buyer; (iii) the minimum number of packs the Live Seller will open for the Live Buyer (the “Minimum Packs”), which the Live Seller must open in full even if a Hit is revealed before the Minimum Packs have all been opened;(iv) the maximum number of packs the Live Seller will open (the “Safety Cap”); and (v) what the Live Buyer will receive if no qualifying Hit appears within the Safety Cap (e.g., the best card pulled or a full refund). All packs opened in a Open Til You Hit Break must be Original Sets. For clarity, this policy does not set a minimum number of Minimum Packs, and the Live Seller may set the Minimum Packs at any number, including one (1), provided it is clearly disclosed. The Live Seller may not alter the Hit definition mid-session. All other provisions of this policy apply to Open Til You Hit Breaks.
Repacks
A “Repack” is a Card Set that has been opened, curated, and resealed by a person or entity engaged in the business of sourcing, curating, and reselling sealed trading-card products assembled from previously opened Original Sets or other cards (a “Repack Manufacturer”), and that is offered for sale as a sealed, unopened product whose specific contents are not known to the Live Seller or any Live Buyer until it is opened live. A Repack is distinct from an Original Set and, except as expressly permitted below, is otherwise subject to all requirements of this policy that apply to Breaks generally, including the visibility, disclosure, and prohibited-conduct requirements set out above.
Repack Manufacturer Eligibility
A Live Seller may only offer a Repack for sale if the Repack was produced by an Eligible Repack Manufacturer. An Eligible Repack Manufacturer is a Repack Manufacturer that the Live Seller reasonably believes, and can demonstrate with credible documentation upon request, satisfies each of the following criteria at the time the Repack is offered for sale and at all times the Repack remains available for sale until the Break in which it is offered is completed (the “Eligibility Criteria”):
- the Repack Manufacturer is a registered, operating business entity with a minimum of six (6) months of verifiable operating history producing sealed surprise or repackaged trading card products (individuals do not qualify);
- the Repack Manufacturer is independent of the Live Seller offering the Repack for sale such that the Live Seller does not control the contents of the Repack it sells, and has no prior knowledge of the Repack’s specific contents before it is offered for sale;
- the Repack Manufacturer publishes, and keeps current at a stable, publicly accessible URL, a complete checklist for the applicable Repack Series (a “Series” means a named product line or release of Repacks sharing a common checklist) identifying, at a minimum, the manufacturer and series name, item condition, quantity of items, and the card year, player or character name, variation, and grade (as applicable) for each possible item, without stating or implying any floor, ceiling, average, or other value other than manufacturer suggested retail price;
- the Repack Manufacturer represents that all cards included in the Repack are authentic and, where graded, have been authenticated by a recognized independent grading service;
- the Repack Manufacturer maintains written sourcing and sealing procedures and chain-of-custody documentation for each production run sufficient to verify that the contents of a sealed Repack match its published checklist; and
- the Repack Manufacturer is not, to the Live Seller’s knowledge, the subject of any active governmental or regulatory action, or any final adjudication within the preceding twenty-four (24) months, relating to gambling, lottery, deceptive advertising, consumer protection, or fraud;
- any manufacturer suggested retail price or other permitted value reference for the Repack is based on named, verifiable third-party pricing data rather than the Repack Manufacturer’s own internal estimates;
- the Repack Manufacturer has stated at which point the applicable Series will be completed and its contents and quantities will not change;
- the Repack Manufacturer’s and Series’ names are prominently displayed on the physical product; and
StockX does not maintain, publish, or endorse any list of approved or authorized Repack Manufacturers, does not review or approve any Repack Manufacturer or Repack in advance, and does not verify or audit compliance with the Eligibility Criteria before a Repack is listed. The Live Seller is solely responsible for verifying, before listing any Repack, that the applicable Repack Manufacturer satisfies the Eligibility Criteria, and for maintaining records sufficient to demonstrate that compliance to StockX upon request.
Repack Disclosures
In addition to the disclosures required for Breaks generally, before offering a Repack for sale a Live Seller must clearly disclose, verbally on the livestream:
- that the Card Set is a Repack and not an Original Set, and the identity of the Repack Manufacturer;
- that neither StockX nor the Live Seller curated, selected, or influenced the contents of the Repack, that the Live Seller has no knowledge of the contents of the Repack other than the Repack Disclosures, and that StockX does not vet, approve, audit, or endorse any Repack Manufacturer or Repack.
A Live Seller may not state or imply that a Repack Manufacturer is approved, certified, endorsed, or vetted by StockX. A Live Seller may not advertise or reference any floor, ceiling, minimum, maximum, or average value for a Repack or its contents; a Repack may reference named, verifiable third-party pricing data rather than the Repack Manufacturer’s own internal estimates.
No StockX Review of Repack Manufacturers
Nothing in this policy obligates StockX to evaluate, vet, audit, monitor, or take any action with respect to any Repack Manufacturer or the accuracy of any Repack Manufacturer’s checklist or representations. StockX’s decision to permit Repacks that meet the Eligibility Criteria does not constitute review, approval, or endorsement of any specific Repack Manufacturer or Repack. A Live Seller who lists a Repack sourced from a Repack Manufacturer that does not in fact satisfy the Eligibility Criteria, or that misrepresents a Repack’s contents, is in violation of this policy regardless of StockX’s lack of advance review, and remains solely responsible, as between StockX and the Live Seller, for the accuracy of the Repack and any resulting Live Buyer harm.
Additional Prohibitions
- Live Sellers may not state, or otherwise imply, that the Card Set is a form of investment or will produce any guaranteed return.
- Randomizers of any kind. No physical or digital randomization mechanism of any kind, including without limitation any random number generator, wheel, dice, raffle drum, vending or gumball-style machine, or similar device may be used to decide which Card Set or Slot a Live Buyer gets. For the avoidance of doubt, this prohibition includes random team assignment, random player assignment, and any other method of randomly assigning Slots to Live Buyers, whether conducted through a platform tool, third-party application, or manual process.
- Prizes or bonuses awarded by chance. Breaks cannot include any prize, bonus or other item awarded by chance or any bounty, or “prize pick” awarded to a Live Buyer at random. If any bonus item (e.g., anything other than the Card Set purchased in a Break) is offered to a Live Buyer within a show, each Live Buyer in the show must be offered the identical bonus item at no additional charge.
- No games or other activities involving chance-based or value-based outcomes may be conducted on the Live Shopping Platform, including ones where one person can win, trade, exchange or otherwise transfer possession or ownership of cards from another person based on the outcome of a Break or any game mechanic layered on top of a Break (e.g., “King of the Hill,” survivor, or draft-style games). StockX may, in the future, permit additional formats subject to separate published guidelines or updates to this policy.
- Non-card items. Jerseys, memorabilia, sealed toys, and other non-card items cannot be included as part of or in conjunction with a Card Set.
- Break Sessions cannot span shows or platforms. All products must be sold in a single Break Session. Positions in a Break on the Live Shopping Platform may not be sold off the Live Shopping Platform, including as pre-sales, through loyalty programs, or in advance of the livestream.
- Live Sellers Breaking their own boxes. A Live Seller, and their household members, family, or employees, or individuals related to the Live Seller through other relationships or shared account use, may not buy a spot or otherwise participate in a Break that the Live Seller is running.
- Purchases with contingent side deals. Offering to buy back, trade for, or pay a bonus for a card contingent on when, where, or whether it is pulled during a show.
Relation to Other StockX Policies
This policy works together with and supplements StockX’s Terms of Service and any applicable Promotion Guidelines and Rules, which govern gambling and purchase-based prizes across the StockX Platform generally. For the avoidance of doubt, purchase-based prizes include any prize, bonus, bounty, or other item of value awarded to a Live Buyer contingent on a purchase, including without limitation prizes triggered by pulling a specific card or achieving a specific outcome during a Break. If anything in a Break conflicts with those policies, the Terms of Service and any applicable Promotion Guidelines and Rules controls with respect to the conflicting provision(s). A Break run in compliance with this Card Breaking Policy, where Live Buyers purchase a specific, disclosed team or Slot and receive a guaranteed, disclosed reward (i.e., one or more cards or an alternative card of at least the disclosed minimum value), is not a “Promotion” under those policies and does not trigger any no-purchase-necessary, alternative-method-of-entry, or Official Rules requirements.
No StockX endorsement
StockX does not run, administer, or guarantee the outcome of any Live Seller’s Break. Running a Break is the Live Seller’s responsibility, and a Live Seller may not state or imply that their Break is sponsored, endorsed, administered by, or affiliated with StockX. StockX does not review Breaks in advance for compliance with this policy; our enforcement, described below, happens after the fact.
The Live Seller is solely responsible for sourcing Original Sets, accurately describing the Break, opening the product live and shipping the actual cards to the Live Buyer.

Future Formats
StockX may, from time to time, update this policy or publish separate guidelines permitting additional Break formats, game mechanics, or engagement features that would otherwise be prohibited under this current policy. Any such format will be permitted only to the extent expressly authorized by this policy or any applicable guidelines, and only in compliance with all requirements set forth therein. Unless and until StockX expressly permits a given format, the prohibitions in this policy apply. Users should review this policy periodically for updates or changes.
Seller Eligibility
Live Sellers must meet all eligibility requirements established by StockX for the Live Shopping Platform before conducting a Break. StockX may, in its sole discretion, establish and modify seller qualification criteria, which may include without limitation minimum account standing or performance metrics, completion of a seller verification or onboarding process, and compliance history with this policy and other StockX policies. StockX reserves the right to limit Break access to pre-approved sellers.
Responsible Purchasing
StockX is committed to promoting responsible purchasing on the Live Shopping Platform. StockX may, in its sole discretion, implement purchasing safeguards, which may include without limitation daily or session-based purchase limits, cool-off periods between purchases, or age-based purchasing restrictions. Live Sellers may not encourage Live Buyers to circumvent any purchasing safeguards implemented by StockX.
How we enforce this policy
StockX reserves the right, but is not obligated, to review activity on the Live Shopping Platform for compliance with StockX’s policies and applicable laws, and to strictly enforce this policy in its sole discretion. If a Break, Repack, or other conduct is not compliant with this policy in any way, including a failure to satisfy the Repack Manufacturer Eligibility Criteria or the Repack Disclosures set forth above, StockX may take any and all appropriate action, which can include without limitation a warning, limiting or removing a broadcast, immediately suspending or permanently terminating a Live Seller’s access to the Live Shopping Platform, or other appropriate action. StockX does not publish, and is not bound by, any strike schedule, fixed cure period, or mandatory remediation steps before taking action under this policy, and may apply escalating severity as an internal practice without being committed to any specific published sequence. Nothing in this policy requires StockX to pursue a graduated approach before acting, and StockX may act immediately where conduct independently warrants it, including without limitation conduct that appears to constitute unlawful gambling, egregious fraud, or other serious misconduct.Updates to this policy
