THIS CAMPAIGN IS INTENDED FOR RESIDENTS OF JAPAN ONLY AND WILL BE GOVERNED BY JAPANESE LAW. Ā DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN JAPAN AT THE TIME OF ENTRY. OPEN TO LEGAL RESIDENTS OF JAPAN WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY, WHO ENTER FROM WITHIN JAPAN.

THE CAMPAIGN IS RUN FOR THE BENEFIT OF A CHARITY. NINETY PER CENT (90%) OF THE PROCEEDS FROM EACH DONATION WILL BE TRANSFERRED TO THE CHARITY. THE REMAINING TEN PER CENT (10%) REPRESENTS A PROCESSING FEE THAT APPLIES TO EACH DONATION THAT IS RETAINED BY STOCKX.

1. Eligibility: The Design Museum Charity CampaignĀ (the ā€œCampaignā€) is open to legal residents of Japan, who are at least eighteen (18) years of age or older and who are located in Japan, at the time of entry. Employees, contractors, directors, officers, and agents of the Sponsor, donors to the Campaign (each a ā€œDonorā€) and the Charity, their parent, affiliates, subsidiaries, distributors, sales representatives, and advertising, promotion and judging agencies and all other service agencies involved with the Campaign, and members of the immediate family (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and household of each such employee (whether or not related) are not eligible to enter or win, regardless of where they reside.

This Campaign is subject to all applicable laws and regulations and is void where prohibited.Ā  Participation constitutes entrantā€™s full and unconditional agreement to these Promotion Official Rules and Sponsorā€™s decisions, which are final and binding in all matters related to the Campaign.Ā  Winning a prize is contingent upon fulfilling all requirements set forth herein.

2.Sponsor: StockX LLC, 1046 Woodward Ave., Detroit, MI 48226, USA, https://help.stockx.com.

3.Campaign Period: The Campaign begins on October 1, 2021 at 12:00pm Eastern Daylight Time (ā€œEDTā€) and ends on October 3, 2021 at 12:00pm EDT (the ā€œCampaign Periodā€). The Campaign Period consists of a ā€œDonation Periodā€ and a ā€œMail-In Periodā€ as follows:

  • The Campaignā€™s ā€œDonation Periodā€ shall start on October 1 2021, at 12:00pm EDT and ends on October 3, 2021, at 12:00 pm EDT
  • The Campaignā€™s ā€œMail-In Periodā€ shall start on October 1, 2021, at 11:59 am EDT and ends on October 3, 2021, at 11:59 am EDT

All entries must be submitted during the Campaign Period.

4.How to Enter:Ā  There are two ways to enter the Campaign:

  • To enter by making a donation in the Donation Amount: Go toĀ the Donation Page URL log in to your account (or create one for free) and make a donation in the Donation Amount to the Charity by following the instructions. Every donation in the Donation Amount made during the Donation Period provides the participant with one (1) Campaign entry. To receive an entry into the Campaign via this donation method, you must make the donation during the Donation Period by transferring the necessary funds to the Sponsor by the end time/date of the Donation Period. For the avoidance of doubt, donations made after the Donation Period end time/date will not be eligible for entry into the Campaign, unless an entrant decides to enter the campaign without making a donation in line with the mail-in entries detailed below.Ā All entries into the Campaign are eligible for Prizes, subject to the limits (as defined below). PLEASE NOTE THAT NINETY PER CENT (90%) OF THE PROCEEDS FROM EACH DONATION WILL BE TRANSFERRED TO THE CHARITY. THE REMAINING TEN PER CENT (10%) REPRESENTS A PROCESSING FEE THAT APPLIES TO EACH DONATION THAT IS RETAINED BY SPONSOR.
  • To enter by making a mail-in entry: To enter the Campaign by mail-in hand-print your full name, date of birth, mailing address, telephone number and email address on a 3ā€ x 5ā€ card, and mail to: StockX, Charity Campaign Name, 1046 Woodward Ave., Detroit, MI 48226, to receive one (1) entry into the Campaign. Requests must be postmarked and received no later than the end of the Mail-In Period. Each mail-in entry must be in a separate postmarked outer envelope. Mail-in entry prizes are awarded at the same time as donation entry prizes. No facsimiles or mechanical reproductions of entries are allowed. Sponsor is not responsible for lost, late, illegible, misdirected, mutilated, incomplete, or postage-due mail/entries. Submissions become property of Sponsor and will not be returned.

Each Campaign entry, whether by donation or mail-in, puts you into the draw to win one of the Prizes (defined below).

Limits: There is no limit to how many entries you may make, either via the donation or mail-in entry methods. Individuals who do not provide the required information, successfully enter the Campaign, timely submit their entry, and/or abide by these Campaign Official Rules or other reasonable instructions of Sponsor may be disqualified.

Automated entries are prohibited, and any use of automated devices will cause disqualification. Any entrant that attempts to complete or submit fraudulent entries will be disqualified (including all of that entrantā€™s entries) in Sponsorā€™s reasonably exercised discretion. Multiple entrants are not permitted to share the same e-mail address. Should multiple users of the same e-mail account enter the Campaign and a dispute thereafter arises regarding the identity of the entrant, the authorized account holder of the said e-mail account at the time of entry will be considered the entrant. ā€œAuthorized Account Holderā€ is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. A potential winner may be required to show proof of being the Authorized Account Holder.

5.Drawing: On or around the Selection Date, Sponsor will randomly select the Number of Winners from all eligible entries during the Campaign Period. The odds of winning a prize depend on the number of eligible entries received during the Campaign Period. The draw will be performed by a computer process using algorithms to randomly select and assign the category of prize. This will involve reliable software and hardware solutions provided by reputable providers and suppliers in order to ensure the accuracy and correctness of the drawing process. In addition, all the activities as related to the promotion lottery will be carried out and supervised by appropriately trained individuals who have experience in organizing such promotions.

On or around Announcement Date, potential winners will be notified via the e-mail address and/or telephone number they provided to enter into the Campaign. Potential winners are subject to verification of eligibility by Sponsor. If a potential winner is found not to be eligible or not in compliance with these Campaign Official Rules if attempted notification or any prize is returned as undeliverable, if any required documents are not returned within the required number of days, if a potential winner cannot be verified, or if a potential winner is otherwise unable or unwilling to accept and claim the prize as stated, then the potential winner may be disqualified and the prize may be forfeited in Sponsorā€™s reasonably exercised discretion. In the event that a potential winner is disqualified for any reason, Sponsor reserves the right to award the prize to an alternate entrant who will also be selected randomly. Where lawful under applicable law, winners may be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and a Publicity Release, within seven (7) days of attempted notification or the prize may be forfeited. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.

6. Prize: The Prizes and the Number of Winners is set forth above, along with the Approximate Rate Value (ā€œARVā€) of each prize.

Winners of merchandise are unable to choose the specifications of such merchandise including, without limitation, size, style or color. All product details will be determined by Sponsor in its reasonable exercised discretion.Limit:

Approximate Retail Value (ā€œARVā€) is as of the date of printing of these Promotion Official Rules (as stated at the top of these Promotion Official Rules). The difference in the value of the prizes as stated herein and value at the time of prized notification, if any, will not be awarded.

Prizes are non-transferable and no cash equivalent or substitution of prize is offered, except at the reasonably exercised discretion of the Sponsor. In the event of unforeseen circumstances, if a prize, or any portion thereof, cannot be awarded, Sponsor shall substitute the prize with another product of equal or greater value.Ā  Prize winners will be solely responsible for all applicable taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used except such taxes which Sponsor is the direct subject of pursuant to applicable legislation. The ARV of the prize is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes where required by law.

7.Release: As a condition of entering, entrants agree (to the maximum extent permitted by applicable law): (a) to release Sponsor, Charity, and Donors, and each of their affiliates, subsidiaries, retailers, and agents, and each of their officers, directors, employees and agents (ā€œPromotion Partiesā€), from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prizes except for warranty claims resulting from the delivery of a defective item) or for damages resulting from injury to life, body or health and other damages resulting from a grossly negligent or intentional breach of duty;(b) under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby knowingly and expressly waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses and/or any rights to have damages multiplied or otherwise increased; and (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred (if any), excluding attorneysā€™ fees and court costs.

8.Publicity: Except where prohibited by law, each winner grants (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use his/her name, photograph, and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented including without limitation on paper, audio, video, audio-visual, electronic, digital or online media on worldwide basis and royalty-free basis for a term of two years as of their selection as winners.

9.General Conditions: To the extent allowed under applicable law, Sponsor is not responsible for lost, late, misdirected, undelivered, incorrect, or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Campaign or by any technical or human error which may occur in the processing of the entries. Sponsor reserves the right to cancel, suspend and/or modify the Campaign, or any part of it, if any fraud, bugs, virus, technical failures, or any other factor beyond Sponsorā€™s reasonable control impairs the integrity or proper functioning of the Campaign, as determined by Sponsor in its reasonable discretion. In the event of cancellation, Sponsor will randomly award the prizes from among all eligible, non-suspect entries received prior to cancellation. Ā Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions, the website, or network connections that are human or technical in nature. Sponsor reserves the right, in its reasonably exercised discretion, to disqualify any individual and his/her entries it finds to be tampering with the entry process, the website, or the operation of the Campaign or to be acting in violation of the Campaign Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Campaign may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Ā Sponsorā€™s failure to enforce any term of these Campaign Official Rules shall not constitute a waiver of that provision.

10.Governing Law & Jurisdiction: Except where prohibited by law, this Campaign and its Promotion Official Rules are governed by Japanese law and are subject to all applicable laws and regulations.

11.Entrantā€™s Personal Information: Ā  The personal data you provide shall be processed by the Sponsor, as data controller for the purpose of managing your participation in the Campaign and, where applicable, delivering the prize, based on the contractual relationship between you and the Sponsor.Ā Ā Your personal data may be disclosed to third parties and subject to international transfer to territories outside Japan. You may exercise all your rights including the right to access, erasure, rectification, restriction, objection and data portability, as well as withdraw your consent at any time and free of charge.Please see the privacy policy located at https://stockx.com/privacyĀ for details of Sponsorā€™s policy regarding the use by the Sponsor of your personal information collected in connection with this Campaign. Ā If you are selected as a winner, your information may also be included in a publicly-available winnerā€™s list.

12.Winnerā€™s List: A list of winners will be available at https://stockx.com/news/ja-jp/collected-promo-winners on or around Announcement Date.

13.Charity information and solicitation statement

Before you make any donation, please read and acknowledge this important legal statement:

StockX LLC is paid 10% of the value of each amount donated under and in accordance with the Campaign, with such amount being subtracted from each donation received. Other than this amount paid to StockX LLC, the remainder of all amounts donated to StockX LLC under the Campaign, being 90% of each donation, shall be paid to the Charity.

More specific details are included below:

  • This Campaign, and the donations collected hereunder, is intended to benefit the Charity.
  • A copy of the Sponsorā€™s documented formal agreement with the Charity can be made available to regulatory bodies in accordance with any applicable laws.
  • All donations received pursuant to the Campaign will be transferred to the Charity minus a 10% processing fee applied against each donation that is retained by StockX to support StockXā€™s administration and processing of the donations.
  • There is no limit on the contributions to be made by the Sponsor to the Charity and no cut-off point for contributions by participants making donations.
  • There are no specific target donations sought by the Sponsor for the Charity.
  • The Sponsor can make available information on the current and/or final total of contributions made on request.

14. Translations:Ā  A copy of these Official Rules in Japanese can be found here. In the event of any inconsistency between different language versions of these Official Rules, the English version shall prevail.
